On the heels of a federal judge's dismissal of the Lindsay Manufacturing Co. indictments, another federal judge issued yet another blow to the U.S. Department of Justice's prosecution of cases involving the Foreign Corrupt Practices Act. On Jan. 16, 2012, District Judge Lynn Hughes of the Southern District of Texas acquitted John O'Shea of 12 FCPA counts, finding that the government could not meet its high burden of proof since its chief witness, Fernando Basurto Jr., was unable to connect O'Shea to the bribery of a foreign official.
