Our Labor and Employment team often works in tandem with the Employee Benefits team to advise employers of their rights and duties under:
- Consolidated Omnibus Budget Reconciliation Act (COBRA)
- Employee Retirement Income Security Act (ERISA)
- Other federal and state employee-benefit laws
Our lawyers are also experienced in defending ERISA and other benefits litigation, as well as handling cases involving fiduciary duty, denial of benefits and ERISA preemption.
Public sector employment issues
We understand the unique labor and employment problems facing employers today. We advise and represent clients in cases arising under Section 1983 of the 1871 Civil Rights Act alleging denial of procedural or substantive due process and other violations of the United States Constitution. We also defend similar constitutional claims.
We also deals with topics of special concern to public employers, including:
- Collective bargaining
- Drug-testing implementation
- Open-record and meeting requirements
Employment contracts / agreements
Increasingly, companies are using employment contracts to protect their intellectual property and retain their top performers. We regularly help negotiate and draft employment agreements for executives and key employees.
We are also regularly involved in injunctive proceedings, trials and arbitrations concerning employment agreements, including cases involving non-compete agreements, confidential information trade secret agreement breaches and the "inevitable disclosure" doctrine.
